What Do I Do If There Is 'Guidance' That Says I Can't Do Something But The Law Says I Can?

What Do I Do If There Is 'Guidance' That Says I Can't Do Something But The Law Says I Can? What Do I Do If There Is ‘Guidance' That Says I Can't Do Something But The Law Says I Can?

I have just heard from someone who has contacted me because they are being told that they can't use certain techniques because they are not allowed to use them.

The problem is that they feel if they are not allowed to use these specific techniques the risk to the service user and staff will increase immensely.

So, they have asked me how they stand legally on this and whether their company policy and the guidance that they have been given over-rides the law.

Now I am not a lawyer so I can't give legal advice, but what I have done is put this video together to show how we explain the hierarchy of law using a simplified model to help staff and management understand how this hierarchy works.

Hope it helps and feel free to share.

Best Regards

Mark
